Mass Deportation Policy and the Constitution: My Testimony Before the Senate Spotlight Forum

On Wednesday afternoon, I am testifying at a Senate spotlight forum titled “Cruel and UnAmerican:  The Abuse of Immigrants to Attack our Constitutional Order.”  From the executive order purporting to limit the 14th Amendment right to birthright citizenship, to the invocation of the Alien Enemies Act to remove Venezuelans to El Salvador without due process of law, to the use of 10 U.S.C. § 12406 to prospectively federalize and deploy the National Guard to protests across the country, my brief written testimony highlights the multiple facets of the president’s mass deportation policy that threaten constitutional rights of both citizens and noncitizens.

The forum is convened by Senator Dick Durbin (D-IL), Ranking Member of the Senate Judiciary Committee.
